This post is a transcript of a presentation that was given on 22 April 2021 at the LUISS Law School during a webinar on “Rules and Tools: Exceptions and technologies in the DSM Directive” within the activities of BILL Blockchain, artificial Intelligence and digital innovation Law Lab.

Papierbücher können weiterverkauft werden, E-Books nicht: dagegen möchte Justizminister Thomas Kutschaty vorgehen. Ich habe diese Initiative der Landesregierung von Nordrhein-Westfalen zum Anlass genommen habe, mich in einem längeren Post mit der Frage nach dem Dateneigentum bei eBooks auseinanderzusetzen. Golem berichtete zum Jahresende über eine politische Initiative für den Weiterverkauf von Ebooks. Papierbücher könnten weiterverkauft werden, Ebooks hingegen nicht: Gegen diesen Unterschied wolle die Landesregierung Nordrhein-Westfalen nun vorgehen.

Die Debatte über einen digitalen Gebrauchtmarkt ist nicht neu, und sie wird international schon lange geführt (in Deutschland und den Niederlanden beschäftigt die Frage nach der Möglichkeit zum Wiederverkauf von Ebooks die Gerichte). Einen konstruktiven Beitrag dazu kann ich aber auf dem vom Justizministerium eingerichteten Portal Digitaler-Neustart.de bislang nicht erkennen. Ich möchte jedenfalls im Folgenden dazu beitragen, indem ich eine Reihe von Aspekten und Fragen in die Diskussion einbringen möchte.
